Merkado SMS Program Overview

Merkado offers an integrated SMS messaging service as part of its all-in-one platform for small business owners. By opting in to receive SMS messages from Merkado, you agree to these Terms and Conditions and consent to receive text messages on your mobile phone number.

1. Program Description

The Merkado SMS Program is a customer communication service that enables businesses using the Merkado platform to send important information and updates to their customers via text message. This service is operated by Merkado and is designed to enhance customer engagement, provide critical account information, and facilitate seamless business-customer interactions.

2. Message Types

You may receive the following types of SMS messages through the Merkado SMS Program:

Verification Codes and Two-Factor Authentication (2FA): Security-related messages containing codes or authentication requests needed to verify your identity and access your account.
Account Notifications: Important updates about your account status, transactions, orders, billing, and service changes.
Customer Care Messages: Transactional messages from businesses, including order confirmations, shipping updates, appointment reminders, and customer support responses.

3. Message Frequency

The frequency of SMS messages will vary based on your account activity and the actions you take within the Merkado platform. Message frequency is determined by:

Your activity on the Merkado platform (transactions, account access, etc.)
Your interaction with business services using Merkado
Security requirements (verification codes, authentication requests)
Your preferences and communication settings

Merkado makes no guarantee regarding the number of messages you will receive, as this depends entirely on your usage and the businesses you interact with through the platform.

4. Message and Data Rates

Message and data rates may apply. Standard message and data rates from your wireless service provider may be charged for each SMS message you send and receive. Merkado is not responsible for any charges or fees imposed by your mobile carrier. Please contact your wireless service provider for information about your plan and applicable rates.

5. Opt-Out Instructions

You may opt out of receiving SMS messages from Merkado at any time. To unsubscribe from SMS messages:

Reply "STOP" to any SMS message you receive from Merkado. You will receive confirmation of your opt-out request.
After opting out, you will no longer receive SMS messages from Merkado, except as required by law or for critical account security purposes.
You may choose to opt back in at any time by following the prompts in your Merkado account settings or by replying to a message with "START".

Ensuring that the phone number associated with your account is accurate and currently in use by you.
Notifying Merkado immediately if your phone number changes or if you believe your account has been compromised.

10. Disclaimer of Warranties

The Merkado SMS Program is provided "as is" without warranty of any kind. Merkado does not warrant that:

Messages will be delivered without delay or error.
Messages will be received by the intended recipient.
The service will be uninterrupted or error-free.

Factors beyond Merkado's control, including wireless carrier limitations and network conditions, may affect message delivery and timing.

11. Limitation of Liability

To the fullest extent permitted by law, Merkado shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to the SMS program, including but not limited to:

Failed or delayed message delivery
Loss of data or information
Business interruption
Lost profits or revenue

12. Modification of Terms

Merkado reserves the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting to the Merkado website. Continued use of the SMS service following posted changes constitutes your acceptance of the modified terms. We encourage you to review these terms periodically for updates.

13. Governing Law
